General

These general terms and conditions (“Terms”) apply when you, as a consumer (“you”), use the Belly Balance app (“Service”) or visit the website www.bellybalance.co.uk. Agreements are entered into between you and Belly Balance Sverige AB, organization number 556973-8650 (“Belly Balance”). Detailed contact information and other information about Belly Balance are available in the Service. The Terms apply only to you as a consumer of the Service. If you are a corporate customer, please contact Belly Balance for more information.

If you are under 18 years old, you need your guardian’s approval to purchase anything offered through the Service.
1.3
Belly Balance uses the scientific dietary treatment FODMAP in the Service. The Service, as well as all content therein, is owned by Belly Balance or its licensors. The information is protected by intellectual property laws. This means that trademarks, company names, product names, images and graphics, design, layout, as well as information about goods, services, and other content may not be copied or used without written approval from Belly Balance. However, you may make prints of material for private, non-commercial use.
Agreement
2.1 Creating an account
To access the Service, you must create a Belly Balance account in accordance with the instructions provided in the Service. You may create an account directly in the Service or through another account of yours at a third-party social media service. By creating an account through a third-party social media service, you authorize us to collect information from such an account in accordance with our Privacy Policy. Our Privacy Policy is available at https://www.bellybalance.co.uk/privacy-policy. You can disable the connection between the Service and your third-party account at any time.
The provisions of these Terms and Conditions apply regardless of whether your account has been created directly in the Service or through a third-party social media service.
When creating the account, you must, unless otherwise specifically stated (such as for example any free trial offers being applicable), sign up for and purchase a subscription to the Service (“Subscription”). You must also provide us with a valid payment method, i.e. invoice, direct debit, e-invoice, e-mail invoice or external payment service provider for the Subscription (hereinafter referred to as the “Payment Method”).
Once you have created your account you can access the Service. You log in to your account in the Service by filling in your e-mail address and password or by access to the applicable third-party social media service.
Your account is personal, and you are responsible for all the use of the Service through your account. You are responsible for ensuring that your login details are stored securely and not disclosed to any third party. You undertake to immediately inform Belly Balance AB if any third parties get access to your login details, in which case Belly Balance AB reserves the right to suspend or delete your account without further notice. You are also responsible for damage caused by any unauthorized use of your information.
2.2 Subscription payment
By creating an account and signing up for a Subscription, you undertake to pay a fee to Belly Balance AB for the access of the Services. The subscription fee will be billed at the time you establish your Subscription and on an ongoing basis unless you cancel your Subscription. The subscription runs monthly or annually and is automatically renewed for one month/one year if the subscription is not canceled. Termination must be made no later than 24 hours before your current subscription period expires; otherwise, it will be extended by one month/one year. You can easily cancel the subscription by going to “My Account” in the Service to end the subscription. Payment through Appstore and Google Play is made according to their terms.
Right of Withdrawal
For the purchase of a subscription, a 14-day right of withdrawal always applies in accordance with applicable consumer protection legislation. This means that you have the right to withdraw your purchase by notifying Belly Balance within 14 days from the date you signed up for a Subscription (withdrawal period). If you want to withdraw your purchase within 24 hours you may contact Appstore or Google Play. To withdraw your purchase after 24 hours and before 14 days, send a message to customerservice@bellybalance.se.
Customer Information
When you register a user account or place an order, you will be asked to provide certain personal information. You confirm that the information you provide is correct and complete and are responsible for incorrectly filled information. Information about Belly Balance’s processing of personal data is available in the Privacy Policy.
You undertake to ensure that no one else can use your login credentials. You may not disclose your username and password to any unauthorized person and must ensure that the information is stored in such a way that unauthorized persons cannot access it. You must immediately notify Belly Balance if it is suspected that an unauthorized person has gained access to your password. You are responsible for all purchases made with your login credentials if such notification has not been made.
If Belly Balance suspects that you are abusing your user account or login credentials or otherwise violating the Terms, Belly Balance has the right to suspend you and terminate any subscriptions. Belly Balance also has the right to assign you new login credentials.
Promotions
Belly Balance may from time to time offer promotions in the Service that may have more favorable conditions than those stated in these Terms, e.g., regarding payment or extended right of withdrawal. These more favorable conditions apply as long as the promotion is active. Belly Balance reserves the right to withdraw such promotions at any time. Upon termination or withdrawal of a promotion, these Terms apply.
Limitation of Liability
Belly Balance reserves the right for any potential errors in images and text within the Service, such as incorrect prices and price adjustments (such as changes in prices from currency fluctuations). Belly Balance has the right to correct such errors and to change or update the information at any time.
Belly Balance has no medical liability for its products and services but encourages individuals with health problems to always consult a doctor to assess whether Belly Balance products or services are relevant to their health situation. Belly Balance Service cannot and should not be used as a basis for diagnosis. Beyond what may be stipulated in mandatory law, Belly Balance assumes no responsibility for any kind of damage that may result, directly or indirectly, from the use or misuse of goods or information in the Service or referred to from the Service. Belly Balance employs the scientific dietary treatment FODMAP in the Service.
The Service should only be used as a guide and is not intended to replace professional, medical, nutritional, or other healthcare advice. Consult your doctor if you have questions about your health or suspect you have IBS. When you download, install, and use the Service and its content, you do so at your own risk, and you are responsible for the consequences of your use of the Service.
Information about food in the Service has been compiled based on the ingredient list read via the EAN code. Therefore, Belly Balance cannot, as the information is provided by a third party, verify this information. Belly Balance does not guarantee that such information is true or accurate and disclaims all responsibility for the accuracy, completeness, suitability, or purpose of the information. When using the Belly Balance app, you are using our search technology that allows you to search for information about food products and you are using our categorization according to FODMAP. If you have special dietary needs, allergies, or intolerances, you should carefully check the ingredient list on the actual product packaging before consumption. If you need additional information, you should contact the manufacturer directly. If there is uncertainty, consult your doctor or dietitian.

When you download, install, and use Belly Balance and its content, you do so at your own risk. You are responsible for the consequences of your use of Belly Balance, including what you upload and share.
Belly Balance is only responsible for errors caused intentionally or by gross negligence. If liability for damages arises, Belly Balance’s liability is limited to direct damage.
Belly Balance is not responsible in any case for indirect damage, including but not limited to lost profit, loss of income or revenue, consequential damage, or any liability towards third parties.
Belly Balance’s total liability per calendar year shall be limited to the amount the Customer has paid to Belly Balance for the Service during the six (6) months period preceding the occurrence of the damage.
Force Majeure
Belly Balance is not responsible for delays caused by circumstances beyond Belly Balance’s control, such as general labor disputes, war, fire, lightning, terrorist attack, changes in government regulations, technical problems, errors in electric/tele/data connections or other communication. These circumstances shall constitute a basis for exemption that entails exemption from damages and other consequences. If such a situation arises, Belly Balance will inform you both at the beginning and at the end of the period of the current situation. If the circumstance has lasted longer than two months, both you and Belly Balance have the right to terminate the purchase with immediate effect.
Changes to the Terms
Belly Balance reserves the right to make changes to these Terms at any time. All changes to these Terms will be published in the Service. Changes apply from the moment you have accepted the Terms (in connection with a new purchase or when visiting the Service), or alternatively, 30 days after Belly Balance has informed you of the changes.
Applicable Law and Dispute
Disputes should primarily be resolved amicably after discussion with Belly Balance customer service.
If a dispute cannot be resolved amicably with Belly Balance customer service, you can submit complaints online via the EU Commission’s platform for mediation in disputes, which you can find via the following link http://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case will be automatically forwarded to the appropriate national responsible dispute resolution body. This dispute resolution body will then contact us and try to resolve the dispute without involving the court.
Dispute regarding the interpretation or application of these Terms shall be interpreted in accordance with Swedish law and settled as described above or, ultimately, by a general court.
Special terms if you use the service on apple devices
You understand that Apple Inc. and its subsidiaries may enforce these Terms against you and that you grant Apple this right when you accept these Terms. Apple Inc. will not provide support for the Service. If a third party claims that the Service infringes upon its intellectual property rights, Belly Balance, and not Apple inc., is responsible for investigation, defense, settlement, and discharge of such intellectual property claim. Apple inc. has no warranty obligations under these terms.
